Panel Points Terms & Conditions

Overview

The Itracks Panel Points Program (hereinafter called the “Program”) is a Canada Talk Now member incentive program offered by Itracks which came into effect on July 27, 2009.

Itracks may, in its sole discretion, terminate the Program at any time. Termination of the Program will be made by providing 30 days notice.

Itracks may, in its sole discretion, restrict, suspend, amend, extend or otherwise alter the Program or certain aspects of the Program, with or without notice.

Where notice is given pursuant to any section of these terms and conditions, it will be via email and/or a notice posted on the Itracks website (found at http://www.canadatalknow.ca).

Program Membership

To participate in the Program, an individual must be an Active Member of the Itracks’ Canada Talk Now Panel (a “Program Member”). Program membership is granted in Itracks sole discretion, and may be withdrawn in Itracks sole discretion with or without notification.

An Active Member is defined as an individual who has responded to Canada Talk Now opportunities within the past six (6) months.

If in Itracks sole opinion, a Program Member abuses any of the Program’s privileges, fails to follow any of its terms and conditions, and is found to be abusing the Program, Iracks may, in its sole discretion, revoke any or all of the Program Member’s Points and/or revoke the Program Member’s membership in the Program, with or without notification.

Program Members must advise Itracks immediately of any change of address by emailing register@canadatalknow.ca.

Itracks will not be liable or responsible in any manner for any tax consequences which may flow from participation in the Program. Program Members will be solely responsible for the reporting of any income tax benefit and the payment of any taxes.

Itracks Program Points

Points may be earned by Program Member in connection with the successful completion of a market research project hosted by Itracks or one of Itracks customers, such as a online survey, online qualitative discussion group, community, diary, one-on-one interview, etc.

Points may only be earned by, and will only be deposited to, the account associated with the Program Member who participants in the market research study, unless otherwise specifically permitted by Itracks.

Transferability

Program Points are not transferable or assignable.

Earning Program Points

Points will be awarded based on the number of completes required. Points may range from 1 point or higher, depending on the specific project.

A Program Member cannot hold more than 6,000 un-redeemed points at one time. Program Member will be notified if un-redeemed Points accumulate greater than 6,000 and they will have 30 days to redeem points. After 30 days, any points in excess of 6,000 will expiry immediately with out any right for subsequent entitlement to the Program Member.

Itracks may change the basis on which Points are awarded (including number of Points awarded) at any time, with or without notice, in Itracks’ sole discretion.

Except as specifically provided in these terms and conditions, Program Points have no cash value, and are not exchangeable for cash. The approximate retail value of the Program Points will vary depending on the reward chosen at the time of redemption. Program Points are void if sold, purchased, assigned or transferred, except as specifically provided in these terms and conditions.

Inactive Accounts and Unsubscribing as Canada Talk Now Member

Should any Program Member Point Account not earn Program Points for 12 consecutive months, the Program Member Point Account will be deemed to be inactive, and all accumulated Program Points may be forfeited, with or without notice, in Itracks’ sole discretion.

Program Member must redeem their Points prior to unsubscribing as a Canada Talk Now member. After unsubscribing, the Points become null and void immediately with out any right for subsequent entitlement.

Redeeming Program Points for Rewards

When enough Program Points have been accumulated to obtain the Reward(s) desired from Itracks Reward Partners, the Program Member will login to the member portal, to select their reward and redeem their points.

Once Program Member receives claim codes associated with the redemption of the Program Points, the Program Member will obtain the Reward(s) desired according to the terms and condition of Itracks Rewards Partners.

Only Program Points earned through Itracks can be redeemed for Reward(s) through the Itracks Reward Partners.

Itracks Rewards Partners and Other Offers

Itracks has relationships with other companies (“Itracks Rewards Partners”), whereby Program Points can be redeemed and applied in conjunction with the Itracks Rewards Partners’ programs. Program Members must comply with all rules, regulations, terms and conditions associated with the Itracks Rewards Partners’ programs. Program Members are bound by such terms and conditions, as they may be changed from time to time, with or without notice. Itracks or Itracks Rewards Partners may restrict, suspend, otherwise alter or terminate Itracks Rewards Partners’ programs with or without notice. Program Points that are redeemed through an Itracks Rewards Partner’s program are considered redeemed for all purposes.

Privacy Notice

The information provided by you on your Program application and other information that may be provided by you from time to time, as well as information about your Point earning(s) and redemptions, and any information captured whenever you provide your Program claim codes to Itracks and/or Itracks Rewards Partners, is required by Itracks to award and administer your Program Member Point Account and maintain the accuracy of your information.

Acceptance of Terms and Conditions

By signing a Program application and/or by earning or redeeming Program Points for the first time, the Program Member or potential Program Member (i) certifies that he or she is over the age of majority in the province in which he or she resides (or has obtained the consent of his or her parent or legal guardian), (ii) consents to Itracks’ collection and use of certain personal information, and (iii) agrees to the terms and conditions of the Program, as they may be amended from time to time. The current terms and conditions of the Program are set out on the Itracks Canada Talk Now website (found at http://www.canadatalknow.ca).

These terms and conditions shall be governed by the laws of the Province of Saskatchewan and the laws of Canada applicable therein, and all Program Members attorn to the jurisdiction of the Province of Saskatchewan. All decisions regarding the interpretation of these terms and conditions and the administration of the Itracks Panel Points Program, and any disputes arising therefrom, shall be resolved by Itracks in its sole discretion. All such decisions shall be final and binding on all Program Members. In no event shall Itracks’ liability with respect to the Program, including liability for negligence or breach of contract, be greater than the Points accumulated to the Program Member’s Point Account at the time the dispute arose.
